The Supreme Court on Monday ruled that juveniles who commit crimes in which no one is killed may not be sentenced to life in prison without the possibility of parole.
Five justices, in an opinion by Justice Anthony Kennedy, agreed that the Eighth Amendment's ban on cruel and unusual punishment forbids such sentences as a categorical matter.
The case, which attracted nationwide attention because of a trend toward increasingly strict punishment for juveniles who commit violent crime, could reverberate in Silicon Valley. Four defendants, including three teenage boys, are currently being tried as adults in Santa Clara County for an attack last Halloween on a pair of young trick-or-treaters. The attempted murder charges against them still could result in life sentences, but the Supreme Court ruling ensures the juvenile defendants will have a shot at parole if convicted.
"A state need not guarantee the offender eventual release," Kennedy wrote, "but if it imposes the sentence of life, it must provide him or her with some realistic opportunity to obtain release before the end of that term."
The ruling marked the first time that the court excluded an entire class of offenders from a given form of punishment outside the context of the death penalty. —‰'Death is different' no longer," Justice Clarence Thomas wrote in dissent.
Life sentences with no chance of parole are rare for juveniles tried as adults

California is one of only a few states that had permitted sentences of life without parole for juveniles convicted of non-homicides, but as of November 2009, there were only four such inmates in the state's prisons, according to state Department of Corrections figures. Overall, there are more than 260 inmates who were juveniles serving life-without-parole sentences in California, including those convicted of murder, and four of them are from Santa Clara County.
Marc Buller, Santa Clara County's chief assistant district attorney, said that historically, his office has not sought life-without-parole sentences for juvenile crimes other than murder
"We'd never use it for non-homicides anyway," Buller said. "They can still have situations where they'd spend the lion's share of their life, if not all their life (in prison.)"
The overall vote was 6-3, though that is a little misleading. Chief Justice John Roberts voted with the majority in saying that the inmate who brought the appeal had received a sentence so harsh that it violated the Constitution. But the chief justice endorsed only a case-by-case approach, saying that an offender's age could be considered in deciding whether a life sentence was so disproportionate to the crime as to violate the Eighth Amendment.
The Supreme Court has carved out categories of offenders and crimes that are not subject to the death penalty, including juvenile offenders and those who do not take a life. Monday's decision applied those two decisions to life-without-parole sentences.
The case involved Terrance Graham, who in 2003, at age 16, helped rob a Jacksonville restaurant, during which an accomplice beat the manager with a steel bar. Graham was sentenced to a year in jail and three years' probation for that crime.
The next year, at 17, Graham and two 20-year-old accomplices committed a home invasion robbery. In 2005, a judge sentenced Graham to life for violating his probation.
Kennedy, who was joined by Justices John Paul Stevens, Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor, said both national and international practices supported the court's ruling.
Thomas said the majority was wrong about the facts in the United States and abroad and wrong as a matter of principle to take account of international opinion. Justice Antonin Scalia joined all of Thomas' dissent and Justice Samuel Alito most of it.
Thirty-seven states, the District of Columbia and the federal government have laws allowing life-without-parole sentences for juveniles convicted of non-homicide offenses. That represents, Thomas said, a supermajority of states in favor of the punishment.
Kennedy responded that a study relied on by Graham and supplemented by the court's own research had located only 129 juvenile offenders convicted under such laws. Seventy-seven were in Florida, the rest in 10 other states. Those numbers, Kennedy said, make the sentence "exceedingly rare" and demonstrate that "a national consensus has developed against it."
Thomas drew a different conclusion from the same numbers. "That a punishment is rarely imposed demonstrates nothing more than a general consensus that it should be just that — rarely imposed," he wrote. "It is not proof that the punishment is one the nation abhors."
Kennedy added that the sentences at issue had been "rejected the world over." Indeed, only the United States and perhaps Israel, he said, impose the punishment even for homicides committed by juveniles.
"The judgment of the world's nations that a particular sentencing practice is inconsistent with basic principles of decency," Kennedy wrote, "demonstrates that the court's rationale has respected reasoning to support it."
Thomas disputed Kennedy's math, saying 11 nations seem to allow the punishment in theory. More important, he said, "foreign laws and sentencing practices" are "irrelevant to the meaning of our Constitution." I am emothional

I don’t know why I like water so much. I like drinking water. I like the sea. I like any places with water. So I doubt whether I was a fish or not in my previous generation.
Our school is just located on the sea side, which makes me feel comfortable. Whenever I get the free time, I’d like to go to the sea shore, sometimes with my friends while most of the time just by myself. I like sitting on the sand quietly and listening to the songs sang by the sea.

One of my friends used to ask me whether I had ever observed what the sea looked like on a clear day. I didn’t answer him directly then. But he told me that as far as we could see, the sea and the sky joined together and formed a beautiful arc at the end of our sight. They seemed to be together in the end. While as a matter of fact, there was still a far distance between them, like poles apart. They can’t be together, never ever.
I felt so sorry when heard this, because I knew he was giving me some hint about our relationship. I didn’t know what to say about this. I just said that: “Didn’t you tend to get a bit too sentimental? It meant nothing at all but a natural phenomenon.”
Sometimes I don’t like my way of dealing with things, especially about emotion. I always choose to run away from the eyes, the love and anything else. Why I always choose to run away? Like reading a novel, we cannot change the sad ending, but we can choose not to begin.
